This is a starting point for Outset Athletics' terms of service. It is not legal advice. Have it reviewed by a qualified adviser before launch — in particular the governing law, limitation of liability and dispute resolution sections.
1. Who we are

3. Products, pricing and availability
All prices are shown in US dollars (USD) and may change without notice. We make reasonable efforts to display product colours and details accurately, but we cannot guarantee that your screen renders colour exactly.
Products are subject to availability. We reserve the right to limit quantities, to refuse or cancel any order, and to discontinue a product at any time.
If a product or order is listed at an incorrect price due to an error, we may cancel the order and refund you in full, whether or not the order has been confirmed.
4. Orders and acceptance
An order confirmation email acknowledges receipt of your order; it does not constitute acceptance. Your order is accepted when we dispatch it. We may cancel before dispatch and refund you in full.
You agree to provide current, complete and accurate purchase and account information so we can complete your order and contact you if needed.
5. Payment
Payment is taken at checkout through Shopify's payment processing. We do not store your full card details. By submitting payment information you confirm you are authorised to use the payment method.
6. Shipping, returns and refunds
Shipping is governed by our Shipping policy and returns by our Return and refund policy. Both form part of these terms.
Risk of loss passes to you on delivery by the carrier.
7. Use of the site
You may not use the site to transmit malicious code, to scrape or harvest data, to interfere with its security features, or to infringe anyone's intellectual property. We may terminate your access for breaching these terms.
8. Intellectual property
The Outset Athletics name, logo, product designs, graphics, photography and site content are our property or used under licence, and are protected by applicable intellectual property law. You may not reproduce or use them commercially without our written permission.
9. User submissions
If you send us ideas, feedback, reviews or other submissions, you grant us a non-exclusive, royalty-free licence to use, reproduce and publish them in any medium. We are under no obligation to keep submissions confidential, to pay for them, or to respond.
10. Product use and assumption of risk
Our products are athletic apparel. They are not protective equipment and do not reduce the risk of injury during training. You are responsible for training safely and within your ability, and for seeking medical advice where appropriate.
11. Disclaimer of warranties
Except as expressly stated, the site and our products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose.
Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. Nothing here limits your rights under applicable state or federal consumer law.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the site or our products. Where liability cannot be excluded, it is limited to the amount you paid for the order concerned.
13. Indemnification
You agree to indemnify and hold harmless Outset Athletics and its officers, employees and suppliers from any claim or demand, including reasonable legal fees, arising from your breach of these terms.

Your personal information is handled in line with our Privacy policy.
15. Governing law and disputes
